2. Platform Description

AffiliatesFlow is an affiliate marketing platform that connects affiliates with merchants. Affiliates can promote merchant products and earn commissions on successful referrals. Merchants can list their products and leverage our network of affiliates to drive sales.

3. Eligibility

To use AffiliatesFlow, you must:

• Be at least 18 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

4. Affiliate Terms

4.1 Commission Structure

• Affiliates earn commission rates as set by individual merchants/sellers
• Commission rates vary by product and merchant
• Commissions are calculated on the net sale amount (excluding taxes and shipping)

4.2 Payouts

• Minimum payout threshold: $50
• Payouts are processed via Stripe or PayPal
• You are responsible for providing accurate payment information
• Payouts are subject to verification and fraud checks

4.3 Tracking and Attribution

• Affiliate cookies have a 30-day duration
• Last-click attribution is used for commission assignment
• Self-referrals are prohibited and will result in commission forfeiture

5. Merchant Terms

5.1 Platform Fees

• AffiliatesFlow charges a 6% platform fee on all affiliate-generated sales
• This fee is in addition to the commission paid to affiliates
• Fees are automatically deducted from transactions

5.2 Merchant Responsibilities

• Set fair and competitive commission rates for affiliates
• Provide accurate product information and pricing
• Fulfill orders in a timely manner
• Handle customer service and returns

6. Prohibited Activities

Users are prohibited from:

• Using spam, unsolicited emails, or deceptive marketing practices
• Making false claims about products or earnings potential
• Using trademark bidding or brand bidding without authorization
• Engaging in cookie stuffing or click fraud
• Creating multiple accounts to circumvent rules
• Violating any applicable laws or third-party rights
• Attempting to manipulate or game the tracking system

7. Intellectual Property

All content, trademarks, and intellectual property on AffiliatesFlow belong to KB Software LLC or their respective owners. You may not use our branding or materials without express written permission, except as provided through our official marketing materials for affiliates.

8. Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms of Service
• Engage in fraudulent or abusive behavior
• Damage the reputation of AffiliatesFlow or its merchants
• Remain inactive for extended periods

Upon termination, pending commissions may be forfeited if termination is due to policy violations.

9. Disclaimers

AffiliatesFlow is provided "as is" without warranties of any kind. We do not guarantee specific earnings or results. Past performance of affiliates does not guarantee future results. We are not responsible for merchant actions, product quality, or order fulfillment issues.

10. Limitation of Liability

To the maximum extent permitted by law, KB Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform.

11. Indemnification

You agree to indemnify and hold harmless KB Software LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Palm Beach County, Florida.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the new terms.
